Ah nope! Even free users can use custom layers. Just delete ones you're using / may have been using if you're out of space. I think free accounts only allow 5.
A layer is created, too, when you save tweaks to an existing theme. So there's always multiple layers stored and there should be versions of layers you're not using anymore. :)
